Partner
Ben Stockman is a partner in the Firm's New York Office focusing on employment matters. He has broad experience representing employers nationwide across a wide range of industries, including sports, entertainment, media, healthcare and biotech, and higher education.
Ben is a trial lawyer appearing in state and federal courts, before government agencies, and before arbitration panels. He has successfully defended clients against claims of discrimination, retaliation, hostile work environment, equal pay violations, and equity and contract disputes, as well as violations of the Fair Labor Standards Act and state and local wage and hour laws. He regularly guides clients through investigations and audits by the Equal Employment Opportunity Commission, federal and state departments of labor, state and local divisions of human rights and other regulators.
His practice encompasses traditional labor work, including administrative litigation before the National Labor Relations Board, labor arbitrations, and collective bargaining. Ben has represented employers in NLRB proceedings and trials — including defending against unfair labor practice charges and union organizing petitions — and he has spent significant time at the bargaining table.
Ben also has significant experience counseling employers through the full range of workforce issues: workplace crises, reductions in force, internal complaints, employee onboarding and separation, workplace audits, and human resources operations generally. He takes the time to understand client's business and goals so he can deliver prompt, pragmatic solutions to employee relations issues.
He also conducts employment due diligence for clients in mergers and acquisitions, including structuring executive employment and restrictive covenant agreements, and advises companies on protecting trade secrets and guarding against unfair competition by former employees.
Ben has advised sports leagues, organizations, and executives on internal complaints and investigations, athlete employment and labor relations, and human resources infrastructure tailored to sport-specific operations. Representative matters include guiding an emerging professional sports league through a nationwide restructure and reclassification of coaches, developing policies and drafting contracts for referees at a large multi-state recreational soccer league, negotiating employment and founder agreements for professional sports agents, and advising sports-focused investment funds on employment and restrictive covenant matters.
Before joining Paduano & Weintraub, Ben was a partner at Venable LLP, where he was Co-Chair of the Sports Law Group.
